Age discrimination is so prevalent that it has been called an epidemic. But, age discrimination can be hard to detect. We get a lot of calls from people in their 50s and 60s who were downsized and are suspicious that age bias was a factor. People want to know how to tell if they have an age discrimination case. There is no tell tale sign of age discrimination as each case is unique.
But there are some indicators that you should look for. Companies today have become pretty good at hiding age discrimination and people rarely make overt comments that indicate age bias. In most every age bias case I have handled, the company argues that our client was let go for poor performance or was randomly selected as part of a reduction in force. Here are few key indicators of age discrimination:
- The older employee is replaced by a younger person
- A long history of satisfactory performance and then a series of unjustified low ratings or performance critiques followed by termination.
- The decision maker (the person who decided to fire you) is younger
- A noticeable trend of older workers being fired and replaced by younger people
- Training and development programs given only to younger employees
- Comments indicating age discrimination
